Cases Heard In Circuit Court

Hearings were held before the Circuit Court of Barbour County on February 16, 2024 where the Honorable Judge Thomas B. Hoxie, Circuit Judge of the Nineteenth Judicial Circuit heard the following cases listed below.

Prosecuting Attorney Andrew Lynn Phillips appeared before the Court to present the following criminal cases:

Kevin Dale Poling appeared and pled guilty to two counts of Driving While License Suspended or Revoked for DUI – 3rd Offense and one count of Domestic Assault. The defendant waived a presentence investigation. The defendant was sentenced to a period of six months in the Tygart Valley Regional Jail to run consecutively to a term of not less than one nor more than three years for each count of Driving While License Suspended or Revoked for DUI – 3rd Offense, which will run concurrently. The defendant was informed of his ability to file a motion for the Court to consider other sentencing options. The defendant was represented by his attorney, Dennis Kittle.

Prosecuting Attorney Andrew Lynn Phillips appeared before the Court to present the following criminal cases:

Randall Wayne Kisamore, II appeared and pled guilty to one count of Sexual Abuse in the First Degree. The Court ordered a presentence investigation and psychological evaluation. The defendant was informed of his duty to register as a sexual offender for the rest of his life. The defendant was represented by his attorney, Gregory Michael.

Jeremy Wayne Tacy previously pled guilty to one count of Domestic Battery – 3rd Offense. The defendant was alleged to have violated the terms of the Community Corrections Program. The defendant admitted to the violations and the Court sentenced the defendant to the West Virginia Penitentiary for a period of not less than one nor more than five years. The defendant was represented by his attorney, Dean Morgan.
