Barbour County Grand Jury Indicts 21 Individuals


The May 2024 Term of the Barbour County Grand Jury met on June 03, 2024. Presentments were made by Prosecuting Attorney Andrew Lynn Phillips and Assistant Prosecuting Attorney Kelsey Gross. The Grand Jury was presided over by the Honorable Judge Thomas B. Hoxie, Circuit Judge of the Nineteenth Judicial Circuit. Arraignments will be held on June 21, 2024, beginning at 9 a.m. in the Barbour County Courtroom.


The following individuals had felony and misdemeanor Indictments returned against them by the Grand Jury. All defendants are presumed innocent until and unless proven guilty.


Matilda Ann Barr, Belington, Fraud by Access Device.


Gary Lynn Cale, Belington, Failure to Register or Provide Notice of Change of Sex Offender Registry Information-First Offense.


Joseph Eugene England, Belington, Burglary.


Orlandis Frederick Funderburke Jr., Philippi, Two Counts Terroristic Threats, Two Counts Assault on a Health Care Worker, Four Counts Battery on a Law Enforcement Officer.


Brian Joseph Hardy, Moatsville, First Degree Arson, Eight Counts Attempted Murder, Two Counts Cruelty to Animals, Causing Injuries During an Arson Related Crime.

Brandon Isaiah Harris, Belington, 18 Counts Sexual Abuse in the First Degree, 21 Counts Sexual Abuse by Parent, Guardian, or Custodian, Three Counts Sexual Assault in the First Degree, Five Counts Use of Minors in Filming Sexually Explicit Conduct, Four Counts Child Erotica.


Travis Gene Hite, Belington, Fleeing in a Vehicle in a Manner Showing a Reckless Indifference to the Safety of Others, Child Neglect Creating Risk of Death or Serious Bodily Injury.


Adam Ray Isner, Elkins, Fleeing in a Vehicle in a Manner Showing a Reckless Indifference to the Safety of Others, Possession of a Controlled Substance, Unlawful Restraint.


Nicholas Ryan Jones, Belington, Possession of a Controlled Substance with the Intent to Deliver.


Gerry Lee Loudin, Bridgeport, Financial Exploitation of an Elderly Person.


John Michael Matura Jr., Philippi, Driving While License Revoked for Driving Under the Influence of Alcohol- Third Offense, Possession of a Controlled Substance, Prohibited Person in Possession of a Firearm.


Tiffany Amanda Mauller, Philippi, Failure to Appear.


James Allen Nice, Tunnelton, Two Counts Driving Under the Influence Causing Serious Bodily Injury.


Hayden Joseph Poe, Junior, Two Counts Possession of a Controlled Substance with Intent to Deliver, Prohibited Person in Possession of a Firearm.


Heather Rae Poe, Belington, Possession of a Controlled Substance with Intent to Deliver.


Tyler Paul Shipp, Tunnelton, Failure to Appear, Fleeing in a Vehicle in a Manner Showing a Reckless Indifference to the Safety of Others.


Brandon Todd Sipe, Belington, Child Neglect Creating Risk of Death or Serious Bodily Injury, Driving Under the Influence of Alcohol.

Thomas Bradford Swiger Jr., Philippi, Counterfeiting.
